Legal Requirements

 

BY LAW:

(Health and Safety at Work Act 1974) – Section 2(3)

Every Employer with five or more employees (including part time) must prepare and revise as necessary a written health and safety policy, which details the general policy and the particular organisation and arrangements for carrying it out. This Health & Safety Policy must be brought to the notice of all the employees.

 

BY LAW:

Management of Health and Safety at Work Regulations 1999. Regulation 3.

Every employer shall make suitable and sufficient Risk Assessments of the risks to the health and safety of his employees to which they are exposed whilst they are at work.

 

BY LAW:

Management of Health & Safety at Work Regulations 1999, Regulation 7.

Every employer is required under law to appoint a Competent Person to assist them meet their legal health and safety obligations. An employer who has not made an appointment of a suitable person to fulfil the competent person role is in breach of a statutory duty under health and safety legislation. The appointed Competent Person may be an internal appointment, or an external advisor. However, the advisor does not assume responsibility in law for health and safety matters, this responsibility always remains with the employer and cannot be delegated to an adviser whether inside or outside the organisation

CORPORATE MANSLAUGHTER

New legislation on corporate manslaughter came into effect in April 2008. The new offence means that companies (at senior level) will be guilty of corporate manslaughter if there are ‘gross failures’ in the management of health and safety resulting in death. This means that company directors could face unlimited fines, along with imprisonment if found guilty in court. The key to avoiding prosecution is simply to ensure that your company is following the relevant health and safety legislation.


Health & Safety OHSAS 18001

 

What are OHSAS 18001 and OHSAS 18002?

 

OHSAS 18001 is an assessment specification for Occupational Health and Safety Management Systems. It was developed in response to the need for companies to meet their health and safety obligations in an efficient manner.

To compliment OHSAS 18001, BSI published OHSAS 18002, which explains the requirements of the specification and shows you how to work toward implementation and registration.

Together, this integrated package will provide your business with the practical means of registration:

·        Identify elements of your business that impact on health and safety and gain access to the relevant legislation. 

·        Produce objectives for improvement and a management program to achieve them, with regular reviews for continual improvement 

·        BSI Management Systems will periodically assess the system and, if compliant, register your company or site to OHSAS 18001
